Will of Robert L. Witherspoon, knowing the uncertainty of human life. All my estate Real and personal (except as hereafter excepted) to be equally divided between my son James Vantromp and Daughter Jane Cooper. In case either of them should die, the survivor shall inherit the whole Estate … in case both die without [p.106] leaving lawful Issue, the whole of my property to be equally divided between my two Brothers James H. Witherspoon and George W. Witherspoon. My Executors shall demand of Major Love Gasque, as part of my estate by right of marriage with Jane Cooper heir of Samuel Cooper decd, viz, two thirds of wench Susy and her increase, andin case of refusal to deliver up s'd Property, that they shall immediately enter a suit in the Court of Equity. My executors shall make a proposal to Major Love Gasque that in case he will suffer his wife Elizabeth Gasque to keep, board, and bring up my above named children untill they arrive to the age of ten years, then they will allow him all the profits rising from the labours of the above named Susy. In case Elizabeth Gasque survive her present husband Major Love Gasque, then four of my Negroes be given to her during her life … To my Young friend William James Willson son of Wm Wilson, the sum of five hundred dollars to be paid his seven years after my Decease.
